Terms of Use

These terms govern your use of MakeLesson ("the Service"). MakeLesson is operated by Rudenko Rodion Vadimovich, an individual entrepreneur (FOP) registered in Ukraine, located at Velozavods'ka 26, apt. 57, Kharkiv 61176, Ukraine ("we", "us", "our"). By using the Service, you agree to these terms.

1. Account and Eligibility

You must be at least 18 years old to create an account. Teachers are responsible for sharing worksheets with their students in accordance with their institution's policies. You are responsible for maintaining the security of your account credentials.

2. The Service

MakeLesson allows teachers to create interactive digital worksheets using AI, share them with students, and review student submissions. The Service is currently in early access and may change without notice.

3. Credits, Payments and Subscriptions

The Service uses a credit-based system. Credits are consumed when you use AI-powered features such as worksheet creation, editing, image generation, and audio generation. Credit costs vary by operation. We may adjust credit pricing and allocation at any time.

Merchant of Record. All payments are processed by Creem.io, which acts as our Merchant of Record. When you purchase a subscription, you are entering into a contract with Creem for the payment transaction. Creem handles payment processing, invoicing, sales tax collection, and compliance. By completing a purchase, you agree to Creem's Buyer Terms.

Subscription billing. Subscriptions are billed on a recurring monthly basis through Creem. You will be charged at the beginning of each billing cycle. You can cancel at any time; see our Refund Policy for details.

4. Your Content

Ownership. You retain ownership of the content you create using the Service, including worksheets, text, and uploaded materials.

License to us. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service. This includes sending your content to AI providers for processing.

Responsibility. You are responsible for ensuring that content you upload or create does not infringe on third-party intellectual property rights, and that it is appropriate for educational use.

Source materials are your responsibility. The Service builds lessons from material you supply: text you paste or type, photographs and scans of printed pages, PDFs, images, and audio. Before you upload anything, it is your responsibility to confirm that you hold the necessary rights or permission to use it in this way. Textbooks, workbooks, published worksheets, exam papers, articles, song lyrics, and stock or press photographs are usually protected by copyright. Permission to use such material in your own classroom does not automatically extend to uploading it to an online service, to creating adapted or derivative exercises from it, or to distributing the result to students by link. Licensing rules, educational exceptions, and fair dealing or fair use provisions differ from country to country, and the assessment is yours to make. If you are not certain you may use a source in this way, do not upload it.

We cannot and do not check rights. We have no means of identifying what a file you upload is, where it came from, whether it is published material or your own work, what licence or permission you hold in it, or whether you intend to keep the result to yourself or share it with a class. We therefore do not review, verify, or clear the rights in anything you upload, and we do not check whether a lesson you create may lawfully be adapted, shared, printed, or embedded. The Service performs automated safety screening only, which is not a rights check, and no part of the Service should be read as advice or confirmation that a particular source may be used. That assessment rests with you alone, both when you upload the source and each time you decide how far to distribute the result.

Indemnity. To the extent permitted by applicable law, you agree to indemnify us against third-party claims, losses, and reasonable costs arising from material you upload, from lessons you create or share, or from your breach of this section. This does not limit any right you have that cannot be waived under mandatory consumer protection law.

5. Student Data

When students access worksheets you share, their answers and submissions are stored on our servers. As the teacher, you are responsible for informing students (and their parents or guardians, where applicable) about the use of this Service in accordance with your local regulations.

6. Acceptable Use

MakeLesson is an educational tool intended solely for creating classroom lessons and worksheets. You agree not to use the Service, including any of its AI text, image, or audio generation features, to create, upload, request, or distribute:

• NSFW, pornographic, or sexually explicit content of any kind. This includes any sexual depiction of real or fictional persons, and any content that sexualizes minors, which is strictly prohibited and will be reported to the relevant authorities.
• Content that is violent, gory, hateful, harassing, or that promotes discrimination against any individual or group
• Content that is harmful, abusive, deceptive, or otherwise illegal under applicable law
• Content that infringes the intellectual property, privacy, or other rights of any third party

You further agree not to:

• Attempt to reverse-engineer, hack, or disrupt the Service
• Circumvent or attempt to circumvent our content filters or moderation systems
• Share your account credentials with others
• Use automated tools to access the Service beyond normal use
• Resell or redistribute the Service without permission

All AI image generation prompts are automatically screened for policy compliance. We reserve the right to block generation of, remove, or refuse any content that violates this policy, and to suspend or terminate accounts used to generate prohibited content.

7. Reporting Illegal or Infringing Content

If you believe that something created, stored, or shared through the Service is illegal, or infringes a copyright or other right you hold, tell us at admin@makelesson.com. You do not need an account to report content, and you do not need to be the rights holder to report something illegal.

So that we can act on a report, please include:

• The exact link to the lesson or page concerned. Most lessons are reachable only by link and are not listed publicly, so without the link we usually cannot find the material.
• What the problem is, and which part of the page it concerns.
• If you are reporting infringement, the work you say has been copied and the basis on which you hold the right.
• Your name and an address we can reply to.
• A statement that the report is made in good faith and that the information in it is accurate.

We review every report we receive. Where a report is justified we will remove the material or disable access to it, and we will tell the account holder what was removed and why, so that they can respond or correct the problem. We may suspend or terminate accounts that repeatedly upload infringing or illegal material, as set out in section 10.

Reporting content to us is not a substitute for legal action and does not affect any other remedy available to you.

8. AI-Generated Content

Worksheets are generated with the help of AI models. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all generated content before sharing it with students. We do not guarantee the correctness of AI-generated exercises or answers.

You are the teacher of record. Generated text, questions, answer keys, marking, images, and audio are drafts for you to check, not finished teaching material. They may be factually wrong, out of date, biased, mismatched to the stated level or age group, or unsuitable for your curriculum. Automatic checking of student answers and any automatic first-pass review are aids to your judgement and are not a substitute for it. You decide what to assign, what counts as correct, and what grade a student receives.

Output built from your material. Where a lesson is generated from a source you supplied, the result is an adaptation of that source. Your responsibility for the source under section 4 applies equally to the generated lesson and to anything you share, print, embed, or publish from it.

No responsibility for outcomes of use. To the maximum extent permitted by law, we are not responsible for the educational suitability of generated material, or for any consequence of using it in teaching, assessment, or grading. Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, and any rights you have as a consumer.

9. Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time, especially during the early access period. We will make reasonable efforts to notify you of significant changes.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your worksheets and data may be deleted after a reasonable retention period.

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or content.

13. Changes to These Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of significant changes by posting a notice on our website.

14. Governing Law and Disputes

These terms and any dispute arising from them are governed by the laws of Ukraine, where the Service is operated from, without regard to conflict of law provisions.

If you are a consumer. This choice of law does not deprive you of the protection of any mandatory provisions of the law of the country where you habitually reside. If you live in the European Union, the United Kingdom, or another country whose consumer protection rules cannot be set aside by agreement, those rules continue to apply to you in full, and nothing in these terms limits them.

Where a dispute is heard. If you are a consumer, you may bring proceedings in the courts of the country where you reside, and we will bring any claim against you only in those courts. If you use the Service in a business or professional capacity, including as a school, company, or registered entrepreneur, the courts of Ukraine have exclusive jurisdiction.
